Terms and Conditions of Participation – Tokyopoplive Giveaway

Participation in the giveaway requires acceptance of these Terms and Conditions of Participation. By taking part in the giveaway, the participant accepts these Terms and Conditions. Tokyopop GmbH reserves the right to exclude participants from the giveaway in the event of a breach of these Terms and Conditions.

Organizer

The organizer of this giveaway is Tokyopop GmbH, Curienstraße 2, Haus am Domplatz, 20095 Hamburg. This giveaway is in no way sponsored, endorsed, or administered by, or associated with, Facebook or Instagram.

Eligibility

Participation is open to persons residing in Germany who are at least 18 years old at the time of entry. Employees of Tokyopop GmbH, BCKSTG.AGENCY GmbH, their relatives, and anyone involved in the conception and implementation of this giveaway are excluded from participation.
The participant is the person who owns the Facebook or Instagram account used to enter the giveaway. Participation is free of charge and not dependent on the purchase of goods or services. By entering the giveaway, the participant accepts these Terms and Conditions.

How to Enter

Entry is possible using a personal, publicly visible Facebook or Instagram account. To enter, post a comment under the corresponding giveaway post on Facebook or Instagram.

The giveaway period runs from 10 October 2025 to 17 October 2025. The deadline for entries is 17 October 2025, 23:59 (CET).

Prize

The prize is a merchandise package consisting of:

1× Plush figure

1× NTG T-shirt

1× Notebook set

1× Desk calendar

1× Ballpoint pen

The winners will be selected at random (lottery) on 20 October 2025.

Winner Selection and Notification

The winner of the giveaway will be determined by Tokyopop GmbH from among all participants. A cash payment of the prize value or an exchange of the prize is not possible. The prize is non-transferable. The winner will be notified promptly via message on Facebook or Instagram. In this context, all necessary and relevant information will be provided to the winner free of charge. For the avoidance of doubt, Tokyopop GmbH will only bear the direct costs related to the prize.

The winner must confirm receipt of the prize notification without undue delay, but no later than 72 hours after announcement by Tokyopop GmbH, and must provide the personal details required by Tokyopop GmbH. Otherwise, Tokyopop GmbH is entitled to determine a new winner; the previous winner can no longer claim the prize.

Early Termination

Tokyopop GmbH has the right to end or suspend the giveaway at any time should malfunctions, disruptions, fraud, viruses, or similar serious issues occur that fundamentally impair the administration, security, fairness, integrity, or proper conduct of the giveaway. No claims may be derived from an early termination.

Data Protection & Use

Tokyopop GmbH is entitled, for the purpose of contract execution, to store and process the personal data obtained in connection with the giveaway in accordance with the provisions of the German Federal Data Protection Act to the extent necessary for conducting the giveaway. Such data—except for the winner’s data—will be deleted without delay after the winner has been determined. Participants have the right to information or rectification in accordance with statutory provisions and may withdraw their consent to the processing of their data at any time with effect for the future by sending an email to info@tokyopop.de.

Final Provisions

By participating in the giveaway, the participant confirms that they have taken note of these Terms and Conditions and agree to them. The right of appeal is excluded. Any liability of Tokyopop GmbH and its bodies, employees, and agents for damages arising from or in connection with the giveaway, regardless of the legal basis, is limited to cases of intent or gross negligence. The foregoing does not apply in the event of damage resulting from injury to life, body, or health. Tokyopop GmbH reserves the right to amend or correct these Terms and Conditions for good cause. Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected.

These Terms and Conditions, as well as participation in the giveaway, are governed by the laws of the Federal Republic of Germany.
